The terms for using LodgeOS

1. Who we are

LodgeOS is a property management service provided by Transvo. In these terms, "we", "us" and "our" mean Transvo, and "you" means the business that subscribes to LodgeOS.

2. The service

We provide software that lets you manage bookings, rooms, rates, guest records, payments and accounting records for your property. We provide it as a hosted service over the internet. We do not provide accommodation, and we are not a party to any agreement between you and your guests.

We may add, change or remove features. Where a change materially reduces what the service does, we will tell you before it takes effect.

3. Your account

You are responsible for the accounts you create and for the people you invite to them. Give each member of staff their own account and the lowest level of access that lets them do their job.

Tell us promptly if you believe an account has been used by someone who should not have access to it.

You must be authorised to act for the property you register, and the information you give us during setup must be accurate.

4. Fees and payment

The subscription is charged per property, per month, at the price shown on our pricing page at the time you subscribe. Prices are stated in United States dollars.

Fees are payable in advance. If a payment fails, we will tell you and give you a reasonable period to fix it before access is suspended.

We take no commission on your bookings and no percentage of payments your guests make to you. Payment processors used to collect money from your guests charge their own fees, which are theirs and not ours.

We may change the subscription price. We will give you at least thirty days notice before a change applies to you, and you may cancel before it takes effect.

5. Your data

The data you and your guests put into LodgeOS belongs to you. We process it in order to provide the service, and for no other purpose. What we collect and how we handle it is set out in our privacy policy.

You can export your data at any time while your subscription is active. If you cancel, you can export it for at least thirty days afterwards, and we will delete it after that period unless the law requires us to keep it.

You are responsible for having a lawful basis to hold the guest information you enter, and for what you tell your guests about it.

6. Availability and support

We work to keep LodgeOS available at all times, but we do not promise it will never be unavailable. Maintenance that we expect to interrupt the service will be notified in advance where it is practical to do so.

Support is provided by email and, where published, by phone and WhatsApp, during our stated hours (Monday to Saturday, 8am to 8pm GMT). Problems that stop a property from operating are treated as urgent.

7. Tax calculations

LodgeOS calculates the taxes and levies that apply to your charges, using the rates and rules configured for your property, which we keep up to date to the best of our ability.

These calculations are a tool, not tax advice. You remain responsible for your own tax filings and for checking that the treatment we apply matches your circumstances. If you believe a calculation is wrong, tell us and we will investigate it promptly.

8. Acceptable use

You must not use LodgeOS to break the law, to store data you have no right to hold, or to send messages to people who have not agreed to receive them.

You must not attempt to gain access to another customer’s data, to interfere with the service, or to reverse engineer it beyond what the law expressly permits.

9. Our responsibility to you

We will provide the service with reasonable skill and care. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by negligence.

Subject to that, our total liability to you in any twelve month period is limited to the subscription fees you paid us in that period, and we are not liable for loss of profit, loss of business or indirect loss.

You are responsible for keeping your own records to the extent the law requires. LodgeOS is designed to make that easier, not to replace your obligation to do it.

10. Ending the agreement

You may cancel at any time, effective at the end of the period you have paid for. We do not refund the remainder of a period unless we have failed to provide the service.

We may suspend or end your access if you break these terms in a way that is serious or that you do not fix after we have asked you to. Except where the breach makes it impossible, we will tell you first and give you a chance to put it right.

Ending the agreement does not affect anything either of us already owes the other.

11. General

These terms are governed by the laws of the jurisdiction in which Transvo is incorporated, and the courts of that jurisdiction have authority over any dispute.

If any part of these terms is found to be unenforceable, the rest continues to apply.

We may update these terms. If a change is material we will tell you at least thirty days before it takes effect, and continuing to use LodgeOS after that date means you accept it.
